DECLARATION OF PROTECTIVE

 

COVENANTS, CONDITIONS AND RESTRICTIONS

 

AFFECTING THE CONIFER RIDGE SUBDIVSION

 

 

 

WHEREAS, OAK PARTNERSHIP, hereinafter referred to as "Declarant", is the owner of certain real property situated in Washington County, known as Conifer Ridge.

 

WHEREAS, Conifer Ridge is a duly recorded plat; and

 

WHEREAS, the Declarant desires to declare of public record certain protective covenants, conditions and restrictions upon the ownership of real property;

 

WHEREAS, Conifer Ridge Homeowners Association, Inc., hereinafter referred to as "Association” is an Oregon non-profit corporation formed for the purposes described in its Articles of Incorporation.

 

NOW, THEREFORE, in consideration of the foregoing, the Declarant does hereby declare that the following protective covenants, conditions and restrictions:

 

1. Shall become and are hereby made a part of all conveyances of Conifer Ridge, recorded on the 26 day of October 1994 in Book 93 of Plats at Page(s) 20 -24 and --, in Washington County. Oregon.

 

2. Shall by reference become part of any conveyances of said properties or any part thereof, shall run with said properties, shall be binding on all parties having or acquiring any right, title or interest therein, and shall apply thereto as fully and with the same effect as if set forth in full therein.

 

 

ARTICLE I

 

DEFINITIONS

 

1.01 “Declarant” shall mean OAK PARTNERSHIP, its successors and assigns.

 

1.02 “Association” shall mean and refer to Conifer Ridge Homeowners Association. Inc., an Oregon non-profit corporation which shall be formed pursuant to Article III, Section 1 hereof.

 

1.03 “Member” shall mean and refer to every person or entity who holds membership in the Association.
