Declaration of Protective Covenants, Conditions and Restrictions August 31, 1994

 

 

6.24 Damage to Roads or Curbs During Construction. Any damage to roads, sidewalks, or curbs which occurs during the course of construction of any kind on a lot shall be the responsibility of that lot owner. Repair of such damage, if not undertaken by the Lot owner within thirty (30) days of notice to correct may, at their option, be undertaken by the Declarant or the Association if it has been activated. The cost of such repair shall be billed to and borne by the lot owner and shall be payable within 80 days after it becomes due. Failure to pay for any repair billed shall cause the lot owner to be liable for interest at the rate of fifteen percent (l5%) per annum and cost of collection including attorneys fees and such unpaid amounts shall become a lien on the lot owned by the lot owner.

 

 

ARTICLE VII

 

ARCHITECTURAL CONTROL COMMITTEE

 

7.01 Membership: Appointment and Removal. The Architectural Control Committee referred to herein shall be composed of three members elected annually by the Board of Directors of the Association at the time of the initial formation of the committee. One member shall he elected to serve for a one-year term, one to serve for a two-year term and one to serve for a three-year term. At each such election thereafter, a member elected to fill the position of a member whose term has expired shall be elected for a three-year term. If any member of the Architectural Control Committee is unable or unwilling to act, the Board of Directors shall appoint a successor to serve out the unexpired term. No member of the Architectural Control Committee, however created or constituted, shall receive any compensation or make any charge for services.

 

7.02 Procedures. In the event the Architectural Control Committee fails to act to approve or disapprove a plan within fifteen (15) days after plans and specifications have been submitted to it, approval will not be required and the related covenants shall be deemed to have been fully complied with.

 

7.08 Action. Except as otherwise provided herein, any two members of the Architectural Control Committee shall have power to act on behalf of the Committee, without the necessity of meeting and without the necessity of consulting the remaining members of the Committee. The Committee may render its decision only by written instrument setting forth the action taken by the members consenting thereto.
