Declaration of Protective Covenants, Conditions and Restrictions August 31, 1994

 

 

8.04 Access at Reasonable Hours. For the purpose solely of performing the maintenance referred to in Sections 1 and 2 of this Article, the Association, through its duly authorized agents or employees, shall have the right after reasonable notice to the Owner, to enter upon any Lot at reasonable hours on any business day.

 

 

ARTICLE IX

 

GENERAL PROVISIONS

 

9.01 Duration. The covenants and restrictions of ·this. Declaration shall run with and bind the land, shall inure to the benefit of the Association or the Owner of any land subject to this Declaration, their respective legal representatives, heirs, successors and assigns for a term of fifty (50) years from the date this Declaration is recorded, after which time said covenant shall be automatically extended for successive period of ten (10) years unless an instrument terminating these covenants and restrictions signed by the then members entitled to cast seventy-five percent (75%) of the votes.

 

9.02 Amendments. These covenants and restrictions may be amended during the first twenty (20) years from the date of this Declaration, by an instrument signed by the members entitled to cast not less than ninety percent (90%) of the votes and thereafter by an instrument signed by the members entitled to cast not less than seventy-five percent (75%) of the votes. Any amendment must be recorded. Amendments affecting Common Area Tract "A" shall be approved by Washington County.

 

9.03 Notices. Any notice required to be sent to any Member or Owner under the provisions of this Declaration shall be deemed to have been properly sent when mailed to the last known address of the person who appears as Member of Owner on the records of the Association at the time of such mailing.

 

9.04 Enforcement. Enforcement of these covenants and restrictions shall be by any proceeding at law or in equity against .any person or persons violating or attempting to violate the covenant or restriction, either to restrain violation or to recover damages, and against the land to enforce any lien created by these covenants. Failure by the Association or any Owner to enforce any covenant or restriction therein contained shall in no event be deemed a waiver of the right to do so thereunder.

 

9.05 Severability. Invalidation of any one of these covenants or restrictions by judgement or court order shall in no way affect any other provisions which shall remain in full force and effect.
